2. Scope
These General Terms and Conditions apply to all contracts concluded via the Studio Seidel online shop between Studio Seidel GmbH and consumers or businesses.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code – BGB).
A business is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or
profession (§ 14 German Civil Code – BGB).
3. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
By clicking the button to place an order with an obligation to pay, you submit a binding offer to purchase the goods contained in your shopping cart.
After we receive your order, you will receive an automatic order confirmation by email. The purchase contract is concluded when we expressly accept your order or dispatch the goods.
4. Prices and Shipping Costs
All prices shown are total prices and include statutory VAT.
Shipping within Germany is free of charge.
We currently ship orders placed through our online shop within Germany.
For deliveries to other countries, please contact us before placing your order. A contract for delivery outside Germany will only be concluded following an individual agreement.
5. Delivery
Delivery will be made to the delivery address provided during the ordering process.
We dispatch orders within 14 business days after conclusion of the contract, unless a different delivery time is stated for the respective product.
If there is a delay in dispatch, we will inform you by email.
6. Payment Methods
The payment methods currently available in the online shop will be displayed during the ordering process.
Your chosen payment method will be charged in accordance with the terms of the respective payment service provider.
7. Retention of Title
The goods remain the property of Studio Seidel GmbH until payment has been made in full.
8. Right of Withdrawal
Consumers generally have a statutory right of withdrawal.
Details regarding the conditions, deadlines and consequences of withdrawal, as well as the model withdrawal form, can be found in our Right of Withdrawal policy.
The electronic withdrawal function provided on our website is also available for exercising the right of withdrawal. Withdrawal may also be declared by any other method
permitted by law.
Businesses do not have a statutory right of withdrawal.
9. Liability for Defects and Transport Damage
Statutory rights regarding defects apply.
If an artwork arrives damaged or defective, please contact us as soon as possible at info@studioseidel.de and, where possible, send us photographs of the damage.
Your statutory rights regarding defects remain unaffected.
10. Copyright
The artworks offered are protected by copyright.
By purchasing an artwork, you acquire ownership of the physical artwork. Copyright and rights of use are not transferred.
Reproduction, publication, modification or commercial use of the artwork is not permitted without the appropriate consent of the copyright holder.
11. Data Protection
Information about the processing of personal data can be found in our Privacy Policy.
12. Applicable Law
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
In relation to consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
